CITY OF LENOX

A regular meeting of the Lenox City Council was called to order by Mayor Douglas on September 11, 2023 at 5:30 p.m. at City Hall with the following council members answering roll call: Bowman, Nelson, Zabel and Cruz; Tull was absent. Staff present was City Clerk, Dawne Bowman and City Administrator, Allison Kitzman, and visitors, Colleen Larimer, Jeremy Rounds and Terry Niestadt.

Bowman made a motion to approve the agenda, seconded by Nelson, all ayes, motion carried. Nelson made a motion to approve 8/28/23 minutes, seconded by Zabel, all ayes, motion carried. Zabel made a motion to approve the payment of bills, seconded by Nelson, all ayes, motion carried. Zabel made a motion to approve August 2023 Clerk Treasurer Report, seconded by Bowman, all ayes, motion carried.

At 5:30 PM, Bowman opened the Public Hearing on Proposed Plans, Specifications, Form of Contract, and Estimate of Cost for 2023 Sanitary Sewer Lining Project, seconded by Nelson. There were no comments heard from the public. Bowman closed the Public Hearing, seconded by Nelson, all ayes, motion carried.

Bowman made a motion to approve Resolution 23- 39 Approving Plans, Specifications and Form of Contract for 2023 Sanitary Sewer Lining Project, seconded by Cruz, all ayes, motion carried. Kitzman mentioned there was an addendum to the contract, the completion date would be April 2024.

Kitzman discussed the construction bids for the 2023 Sanitary Sewer Lining Project, as there were 5 bidders for the project. The Engineers estimate for the project was $158,555. Accujet at $98,642, Performance Pipelining at $135,998, Municipal Pipe Tool at $145,592.45, Institutform Technologies at $171,991.37 and Visu- Sewer at $214,055. Kitzman mentioned this project will be paid for with Covid funds, so there could be additions to the project.

Nelson made a motion to approve Resolution 23- 40 Making Award of Contract to Accujet in the amount of $98,642 for 2023 Sanitary Sewer Lining Project, seconded by Cruz, all ayes, motion carried.

Bowman made a motion to approve Resolution 23- 38 Wage Increase for Marlene Hill, seconded by Zabel, all ayes, motion carried.

Zabel made a motion to approve re- appointment of Janis Henderson to Low Ret Housing Board for term of 2 years, expiring 9/2025, seconded by Bowman, all ayes, motion carried.

Nelson made a motion to approve Special Events Permit for Homecoming Parade, seconded by Cruz, all ayes, motion carried.

Zabel made a motion to approve CDBG Draw Request #7 for LMU Water Project in the amount of $114,543, seconded by Bowman, all ayes, motion carried.

At 5:45 PM, Bowman opened the Public Hearing on CDBG Contract 21- WS- 029 Status of Funded Activities for LMU Water Project. Jeremy Rounds and Terry Niestadt, with SICOG, were present to read required statements and update the council on the project. Rounds stated the project is 50% complete and should be completed by December 2023, with the exception of some seeding. Council discussed the bump on N64 that happened when Crane Construction bored under the street. Kitzman mentioned that both LMU and Crane Construction are aware of the issue. There were no comments heard from the public. Bowman closed the Public Hearing, seconded by Zabel, all ayes, motion carried.

Nelson motioned to adjourn the meeting, Cruz seconded, all ayes, motion carried. Meeting adjourned at 5:50 PM.
