CITY OF LENOX

A regular meeting of the Lenox City Council was called to order by Mayor Douglas on August 28, 2023 at 5:30 p.m. at City Hall with the following council members answering roll call: Bowman, Zabel and Cruz; Tull and Nelson were absent. Staff present was City Clerk, Dawne Bowman and City Administrator, Allison Kitzman, and visitors, Colleen Larimer and Will Fargo.

Bowman made a motion to approve the agenda, seconded by Cruz, all ayes, motion carried. Zabel made a motion to approve 8/14/23 minutes with noted correction, re- appointment of 3 members to the Lenox Neighborhood Center Board expires 8/2025, rather than 8/2026 seconded by Bowman, all ayes, motion carried. Zabel made a motion to approve the payment of bills, seconded by Cruz, all ayes, motion carried.

Will Fargo was present to discuss the Phase 1 and 2 of the Walking Trail, stating that the project was complete; however, the seeding will be completed by September 30, 2023. They are also working on fixing the driveway at the rodeo grounds, as the concrete is broken due to livestock trailers cutting the corner. Fargo mentioned they will be fixing this by adding steel in the concrete. There were questions regarding making this better, such as widening the entrance or even adding bollards to keep vehicles from cutting into it. Fargo stated that steel will be the first attempt and hopefully that will keep the concrete from breaking. Bowman made a motion to approve Change Order #1 in the amount of $1,300 for Walking Trail Phase 1 and 2, seconded by Cruz, all ayes, motion carried. Fargo also mentioned that he is beginning Phase 3 of the Walking Trail, which will continue to go north to the golf course.

Bowman made a motion to approve Pay App #3 to Hymbaugh Construction in the amount of $63,726 for Walking Trail Phase 1 and 2, seconded by Zabel, all ayes, motion carried. Kitzman stated the project is complete with the exception of seeding.

Kitzman discussed the property at 710 West Michigan. The City attained this property and the Fire Department burned the house down and now we need to decide what to do with the property. Kitzman offered 3 options: keeping the property, selling the property as is, with no stipulations and selling the property as is, with stipulations and what those stipulations would be. Zabel commented that we need to clean the property prior to accepting bids. Kitzman added that it was decided in a previous meeting to keep the City's costs down and let the buyer clean up the property. It was decided that the City will remove the pile of debris left from burning, then take sealed bids, with a minimum to recoup our costs. Bowman added that we need to get our expenses back that we have put into it. This will be on the next agenda.

Kitzman provided the council with a copy of the FY23 Exam with 1 finding, Segregation of Duties. The council was pleased with the examination.

Bowman made a motion to approve Pay App #2 and Final to Hoffman Communication in the amount of $1,599.30 for Agri - vision Sewer Project, seconded by Cruz, all ayes, motion carried. Kitzman commented that the project is complete.

Bowman motioned to adjourn the meeting, Cruz seconded, all ayes, motion carried. Meeting adjourned at 6:00 PM.
